1. Scope

These Terms and Conditions apply to all purchases made via my online shop on www.nick-wilder.de by consumers and businesses.

2. Products and Description

I offer the following types of products:

  • Physical products, especially printed books
  • Digital products, especially e-books delivered as downloads

 

Product presentations in the shop are not binding offers but invitations to place an order.

3. Conclusion of Contract

By completing the checkout process and submitting your order, you make a binding offer to purchase.

A contract is concluded when I:

  • confirm your order via a separate email, or
  • provide the product (shipping of physical goods or activation of digital downloads).

4. Prices and Payment

All prices are gross prices including applicable VAT.

Accepted payment method:

  • PayPal
  • Stripe (e.g., credit card, Apple Pay, Google Pay)

 

Bank transfer is not offered.

5. Shipping and Delivery

5.1 Physical Products

I ship to:

  • Germany: 3 to 5 business days
  • Europe: 5 to 7 business days
  • USA: 7 to 10 business days

 

Delivery times may vary depending on the shipping provider.

5.2 Digital Products

Digital products (e-books) are made available for download after payment is received.

By purchasing digital content, you expressly agree that:

  • the download will begin immediately, and
  • you lose your statutory right of withdrawal once the download starts.

6. Retention of Title

All goods remain my property until full payment has been received.

7. Digital Content & Usage Rights

When purchasing an e-book, you receive a simple, non-transferable license for personal use only. Sharing, distributing, copying, or making the content publicly available is prohibited.

8. Right of Withdrawal

For physical goods, the statutory 14-day withdrawal period applies.

For digital content (e-books), the right of withdrawal expires once:

  • you consent to the immediate provision of the digital file, and
  • you acknowledge that this consent waives your withdrawal rights.

 

I do not offer voluntary returns beyond the statutory requirements.

9. Warranty

The statutory warranty rights apply.

10. Liability

I am fully liable for intent and gross negligence. For slight negligence, I am liable only for breaches of essential contractual obligations (cardinal obligations).

11. Dispute Resolution

The company is based in the United States. Therefore, the exclusive place of jurisdiction and dispute resolution is Helena, Montana, USA. I do not participate in European online dispute resolution procedures.

12. Contract Language

The contract language is German. English translations may be provided for convenience.
